The case has been taken over by Kenyan deputy Jane Njeri Onyango alongside South African Norman Arendse and Mohamed Mostafa Al Mashta from Egypt.
Both of the nations involved will have a right to have right to appeal if they are dissatisfied with the outcome of the decision of the commission.
